Provider Terms

Draft version 0.1-draft · Draft date: 16 July 2026 · Status: DRAFT — not yet legally reviewed

These draft terms apply to pet-care providers on Waggy, in addition to the general Terms of Service. They cover your status, verification duties, payments and payouts, conduct and account measures.

How to read the highlights in this draft:

[PLACEHOLDER: …] — a company fact that does not exist yet (Waggy is not yet registered). Nothing here is invented.

[LEGAL REVIEW / PRODUCT DECISION: …] — an open question that Belgian legal counsel (or a product decision) must resolve.

1. Your status — independent provider, trader or private individual

You provide services as an independent party. You are not employed by Waggy, and nothing in these terms creates an employment, agency or partnership relationship.

You must declare whether you act as a professional/business provider (trader) or as a private individual, actively confirm that the declaration is accurate, and update it if your circumstances change. Waggy never classifies you automatically and does not conclusively determine your legal or tax status. Your declared status is shown to Owners on your profile and again before they book and pay. New Providers cannot become publicly visible or accept bookings until they have declared; Providers who joined during the private beta and have not yet declared are flagged in-app and must declare before public launch. Waggy administrators may review, verify or correct declarations, with a mandatory reason and a complete audit history. [LEGAL REVIEW: declaration and explainer wording — checklist items LD-1 and LD-6.]

You are responsible for your own tax, social-security and (where applicable) business registration obligations, including assessing whether your activity requires KBO/BCE registration. The status declaration concerns your marketplace legal status only — it is not tax, employment or social-security advice. [LEGAL REVIEW: guidance text for occasional providers under Belgian law.]

2. Identity, contact details and traceability

All Providers must provide accurate identity and contact information and keep it current.

Providers who declare as traders must additionally provide their business details in the app: legal or trading name, KBO/BCE company number, VAT number where applicable, business address and business contact details, plus an optional self-certification of compliance with applicable law. During the private beta only the trader status, legal/trading name and KBO/BCE number are shown publicly; a wider pre-contract disclosure may be required after Belgian legal review. Business details are recorded as self-declared and are only labelled as verified after a Waggy administrator completes an official-registry check or a documented manual verification; declarations and verification decisions are audit-logged, and accounts whose traceability information fails review may be reviewed, corrected or suspended. [LEGAL REVIEW: whether and to what extent DSA Art. 30 traceability obligations apply to Waggy, including any micro/small-enterprise exemption — the platform provides this functionality without conceding that every Art. 30 obligation applies in full; checklist items LD-3, LD-4 and LD-5.]

3. Safety verification duties

Providers must complete identity verification (ID document review) and — for safety-sensitive services — provide a recent criminal-record extract for review. Real document collection starts only after the programme’s legal review completes; you will be notified in-app.

Documents are encrypted, access-audited and auto-deleted after review per the Privacy Policy. Verified status can be revoked (expiry, inaccuracy, incident review). Verification is a safety measure, not a guarantee or endorsement.

4. Your services, availability and performance

You define your services, prices and availability calendar; keep them accurate. Accept only bookings you can perform. Deliver accepted services personally, with reasonable skill and care, and in compliance with animal-welfare law.

During active walks/bookings the platform provides live GPS tracking and photo walk reports to the Owner; enabling these where offered is part of the expected service quality.

Repeated cancellations, no-shows or verified quality/safety complaints may lead to reduced visibility, suspension or removal (Section 8).

5. Payments, commission and payouts

All bookings must be paid through the platform (Stripe). Soliciting or accepting off-platform payment for platform-originated bookings is a material breach; automated signals may flag such attempts for human review.

Waggy charges a platform commission of currently 15% of the booking amount (beta rate), deducted before payout; the exact commission and any changes are always shown in your earnings view before you accept a booking. Commission changes are announced in advance and never apply retroactively.

Payouts run via Stripe Connect to your linked account. You must complete Stripe’s onboarding (including its KYC checks) to receive payouts. Payouts related to a disputed booking or open incident may be paused pending review; the payout audit log records every payout decision.

Tips added by Owners are paid out to you in full (no commission on tips). [PRODUCT DECISION: confirm — checklist item P-1.]

You are responsible for declaring your income; Waggy may be legally required to report platform income to tax authorities under DAC7 rules. [LEGAL REVIEW: DAC7 applicability and reporting duties — checklist item P-2.]

6. Conduct

  • Animal welfare first: never leave an animal unattended in unsafe conditions; follow the Owner’s care instructions; report incidents immediately via the in-app incident flow.
  • No off-platform payment or contact-detail sharing intended to circumvent the platform.
  • No fake reviews, profile misrepresentation or account sharing.
  • Respectful communication; no harassment or discrimination.

7. Insurance and liability

Waggy currently provides NO platform insurance or guarantee. You are strongly advised to hold appropriate civil-liability (BA/familiale or professional) insurance covering pet-care activities. You are liable for damage you cause in performing services, per the general Terms and applicable law. [LEGAL REVIEW: insurance wording and any mandatory coverage — checklist item P-3.]

8. Account measures, complaints and appeals

Waggy may apply measures (warning, visibility reduction, feature restriction, suspension, removal) for breaches, with a statement of reasons and an appeal route via support, except where immediate action is required for safety or fraud. [LEGAL REVIEW: P2B/DSA procedural requirements — checklist item T-2.]

Provider complaints about platform decisions are handled via in-app support ([PLACEHOLDER: support email]) with target response [PLACEHOLDER: e.g. 5 business days].

9. Leaving the platform

You may close your account at any time after completing outstanding accepted bookings and pending payouts. Account deletion triggers the data-deletion cascade in the Privacy Policy (including your verification documents).

Reminder: this document is a DRAFT.

It requires Belgian legal review before public launch and is shown during the private beta for transparency only. The highlighted placeholders above are intentionally visible and unresolved.
